Foreign Trade Mark Registration

As well as obtaining UK, Madrid Protocol and European Community trade mark protection, it is possible to obtain trade mark protection by filing applications directly in foreign countries. Most industrialised nations are party to the Paris Convention, which is an international treaty allowing the filing date of an earlier application in another country to be claimed up to six months after the first trade mark filing. This is called claiming priority, and the earlier application is called a priority application.

For example, we could file a trade mark application in the UK, and then up to six months later, file a Community trade mark application, a Madrid Protocol application designating the USA and Australia, and a Canadian trade mark application. Local attorneys in Canada would represent you on receiving our instructions.

Cost

The filing, prosecution and registration costs vary significantly from country to country and therefore we obtain estimates from foreign attorneys, as required.
