Burden of proof (in certain cases): In cases of infringement when the patent is for a process for obtaining a new product, the burden of proof is reversed. If the same product is produced, there is an assumption that the product is made by the patented process, unless the contrary is proved. Therefore it falls upon the defendant to prove non-infringement.
